These terms apply when you use shimascreations.com or buy from us. By using the site or placing an order, you agree to them. Please read them along with our Refund Policy, Shipping Policy and Privacy Policy, which are part of these terms.

1. Who we are

Shima's Creations LLC ("we", "us") runs this store from Phoenix, Arizona. Our products are handmade in Monument Valley, Arizona, on the Navajo Nation. The store is hosted on Shopify.

2. Our products

Every item is handmade by an enrolled member of the Navajo Nation and is offered as a genuine Indian product under the Indian Arts and Crafts Act of 1990. Our Authenticity page explains what that means.

Because each piece is made by hand, pattern placement, size and color vary slightly from piece to piece and from the photos. Screens also show colors differently. Small variations like these are part of handmade work, not defects.

We describe each piece as accurately as we can. If something arrives materially different from its description, our Refund Policy applies.

3. Orders

When you place an order, you're offering to buy the items in it. We accept your order when we ship it. We may decline or cancel an order, for example if an item is no longer available, if there is an error in the listing or price, or if we suspect fraud. If we cancel an order after you've paid, we'll refund you in full.

Most pieces are one of a kind or made in very small numbers. An item can sell out between the time you add it to your cart and the time you check out.

4. Prices and pricing errors

Prices are in US dollars and don't include shipping or sales tax, which are shown at checkout.

If an item is listed at the wrong price, we'll contact you before shipping and you can choose to buy it at the correct price or cancel for a full refund. If you're ever charged more than the price listed when you ordered, we'll refund the difference.

5. Payment

Payments are processed by Shopify and its payment partners. We never see or store your full card number. By paying, you confirm that you're allowed to use the payment method.

6. Sales tax

We collect sales tax where the law requires it. The amount is shown at checkout.

7. Shipping and returns

Shipping times, costs, delays and lost packages are covered in our Shipping Policy. Returns, refunds, exchanges and cancellations are covered in our Refund Policy.

8. Your account

If you create an account, please give accurate information and keep your login details private. You're responsible for activity on your account.

9. Our designs, photos and words

The designs, photos, text and other content on this site belong to Shima's Creations LLC and its maker. You may share links to our pages and products. You may not copy our photos or descriptions to sell other goods, or use our name, photos or story in a way that suggests other products are made by us.

10. Using the site

Please don't use the site for anything unlawful, try to interfere with how it works, or collect data from it by automated means.

11. Links to other sites

Links to other websites are for convenience. We aren't responsible for their content or practices.

12. Warranties

We stand behind our work as described in our Refund Policy. To the extent the law allows, we make no other promises about the products or the site beyond those in these terms and our policies. Nothing in these terms limits any rights you have under law that can't be waived.

13. Limits on our liability

To the extent the law allows, we aren't liable for indirect or consequential losses arising from your use of the site or our products, and our total liability for any claim about an order is limited to the amount you paid for that order. Some places don't allow these limits, so they may not apply to you.

14. Governing law

These terms are governed by the laws of the State of Arizona and applicable federal law. Any dispute will be handled in the state or federal courts located in Maricopa County, Arizona, except that either of us may bring a claim in small claims court where it qualifies.

15. Changes to these terms

We may update these terms from time to time. The date at the top shows when they last changed. Your order is governed by the terms in place when you placed it.
